These Terms & Conditions ( Terms ) govern your
use of Alhuda Tours websites and travel-related services (the Services ).
By accessing or using the Services, you agree to these Terms.
1) Who We Are
Alhuda Tours LLC ( Alhuda Tours, we, us )
acts as a travel organizer/retailer for trips that may be provided by
independent third-party suppliers (airlines, hotels, ground operators, activity
providers, etc.). We do not own or control the suppliers and are not
responsible for their acts, errors, or omissions, except as required by law.
2) Eligibility & Your Responsibilities
- You must be at least 18 and able to enter a binding
contract.
- You are responsible for the accuracy of all information
you provide (names exactly as on passports, dates of birth, contact
details, payment information).
- You are responsible for passports, visas, entry
requirements, vaccinations/health documents, and complying with
destination laws (including customs and currency regulations).
- You agree to review all confirmations upon receipt and
promptly report any discrepancies.
3) Bookings, Pricing & Payments
- A booking is confirmed when we issue written confirmation upon
receipt of full payments.
- Pricing: Prices are in U.S. dollars unless
stated otherwise and are subject to change before full payment due to
supplier or currency changes, taxes, surcharges, or government fees. We
will notify you of material increases; if you do not pay, services may be
canceled.
- Deposits & Final Payment: Due per the
invoice/itinerary. Missed payments may result in cancellation and no
refunds.
- Payment Methods: We accept payment through
Zelle, Bank Deposit and Wire Transfer. Air-tickets may be charged through
debit/credit card using third party merchant. Chargebacks without first
attempting good-faith resolution may be treated as cancellation by you.
- Special Requests/Accessibility: We will pass
along requests to suppliers but cannot guarantee fulfillment.
4) Changes, Cancellations & Refunds
- By You: Cancellation or changes must be
submitted in writing. Cancellations are non-refundable. Whereas for
changes, suppliers terms control fees and refunds (often nonrefundable or
subject to escalating penalties as travel dates approach). Our
administrative fees may apply in addition to suppliers fees.
- By Suppliers or Force Majeure: Suppliers
and/or we may modify, re-route, or cancel itineraries due to
operational
needs, weather, natural disasters, epidemics, strikes, political
events,
government actions, or other events beyond reasonable control ( Force
Majeure
). Where possible, reasonable alternatives will be offered.
Refunds are subject to supplier policies; travel insurance is strongly
recommended.
- Air Tickets: Most airfares are highly
restrictive, nonrefundable, and subject to change/cancellation penalties
per airline fare rules. No-show typically forfeits the entire fare.
5) Travel Documents & Health
- You must carry valid passports (with required validity),
visas, and health/vaccination certificates. Entry is not guaranteed;
decisions rest with authorities.
- Some destinations/activities involve risks (e.g., terrain,
weather, public health). You assume all such risks and are responsible for
consulting healthcare providers and reviewing official advisories before
travel.
6) Insurance
We strongly recommend comprehensive travel
insurance (trip cancellation/interruption, medical, evacuation, baggage,
supplier default). If you decline insurance, you assume all financial loss
associated with trip changes, cancellations, delays, or medical needs.
7) Supplier Responsibility & Limitation of Liability
Suppliers are independent entities and responsible for
providing their services. To the fullest extent permitted by law:
- We are not liable for acts/omissions of
suppliers or for personal injury, illness, death, property damage, or
other losses arising from supplier actions or Force Majeure.
- Our total liability for claims arising from or related to
the Services will not exceed the amount you paid to us as our service fee for
the relevant booking giving rise to the claim.
- We are not responsible for incidental or consequential
damages, lost profits, or punitive damages.
Nothing in these Terms limits liability where such
limitation is prohibited by law.
8) Code of Conduct
You agree to behave respectfully toward staff, guides, and
fellow travelers; comply with instructions for safety; and refrain from illegal
or disruptive conduct. We may remove any traveler whose behavior poses a risk
or substantial disruption, without refund.
9) Travel Advisories & Risks
You are responsible for reviewing governmental travel
advisories (e.g., U.S. Department of State, CDC) and for making informed
decisions about travel. By booking, you acknowledge inherent risks and accept
responsibility for your choices.
10) Sanctions & Export Controls
You represent that you are not subject to sanctions and will
not use our Services in violation of U.S. sanctions, export controls, or
anti-money-laundering laws.
11) Intellectual Property & Site Use
All content on our website (text, graphics, logos) is owned
by or licensed to Alhuda Tours and protected by law. You may not copy, modify,
or distribute content without permission. You may not use the Services to
engage in fraud, scraping, or security violations.
12) User Content
If you submit reviews, photos, or other content, you grant
us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify,
and display such content in connection with the Services and our marketing. You
are responsible for the content you submit and for obtaining permissions from
identifiable individuals.
13) Privacy
Your use of the Services is also governed by our
Privacy Policy
. By using the Services, you consent to
our data
practices.
14) Disclaimers
Except as expressly provided, the Services are provided as
is and as available, without warranties of any kind, express or implied,
including implied warranties of merchantability, fitness for a particular
purpose, title, and non-infringement. Some jurisdictions do not allow
disclaimers of implied warranties; portions of this section may not apply to
you.
15) Indemnification
You agree to defend, indemnify, and hold harmless Alhuda
Tours and its officers, directors, employees, and agents from any claims,
damages, losses, liabilities, costs, and expenses (including reasonable
attorneys fees) arising out of your breach of these Terms, your misuse of the
Services, or your violation of law or third-party rights.
16) Governing Law; Dispute Resolution (Arbitration)
These Terms are governed by the laws of the State of California,
without regard to conflict-of-law rules.
Informal resolution: Before filing a claim, you
agree to contact us at umrah@alhudatours.com and allow 30 days to try
to resolve the dispute informally.
Binding arbitration & class-action waiver: Any
dispute not resolved informally will be resolved by binding
arbitration
administered
by the American Arbitration Association under its
Commercial Arbitration
Rules. You and we waive any right to a jury trial and to
participate in
a class action. You may opt out of
arbitration within 30 days of first
accepting these Terms by emailing umrah@alhudatours.com
with subject
"Arbitration Opt-Out" and your name and contact
information. If you do not opt
out, arbitration is the exclusive means of dispute
resolution (except for
claims that may be brought in small claims court).
17) Changes to Services & Terms
We may update the Services and these Terms from time to
time. Updates are effective when posted, unless a later date is specified. Your
continued use after changes means you accept the updated Terms.
18) Severability; Entire Agreement
If any provision is invalid or unenforceable, the remainder
remains in effect. These Terms, together with written booking confirmations and
our Privacy Policy, constitute the entire agreement between you and us
regarding the Services.
